•Your session will take about 2-3 hours. Following your session you will be able to review all the proofs on the computer at a view & order session where you will have the option to purchase any package. Editing can take up to 2-3 weeks.

Policies and Procedures: A $249 NON-REFUNDABLE RETAINER IS REQUIRED TO SECURE YOUR APPOINTMENT DATE AND TIME. THE $249 RETAINER IS TRANSFERABLE UP TO 1 TIME, ANY ADDITIONAL RESCHEDULING WILL REQUIRE ANOTHER $249 RETAINER. ALL CANCELLATIONS OR RESCHEDULING MUST BE DONE 7 DAYS BEFORE YOUR SESSION DATE; FAILURE TO NOTIFY THE STUDIO 7 DAYS BEFORE YOUR SESSION OR DECIDE TO COMPLETELY CANCEL YOUR SHOOT RESULTS IN LOSS OF $249 RETAINER. ALL CANCELLED SHOOTS MUST BE RESCHEDULED AND SHOT WITHIN 60 DAYS OF YOUR ORIGINAL SESSION DATE FOR YOUR $249 RETAINER TO BE TRANSFERABLE. PHOTOGRAPHER RESERVES THE RIGHT TO RESCHEDULE DUE TO ILLNESS, WEATHER, EQUIPMENT MALFUNCATION, OR OTHER CIRCUMSTANCES BEYOND THEIR CONTROL.

•This contract incorporates the entire understanding of the parties. Any modifications to this contract must be in writing and signed by both parties.

•The contract constitutes an order for boudoir photography service.

•Failure to Perform: Although extreme care will be taken with the images and photographs taken, SOUTHERN BELLES BOUDOIR limits any liability for loss. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the retainer to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order. Client assumes all responsibility for the safety of all portraits upon receipt.

•LIMIT OF LIABILITY. Client acknowledges and understands that the Photographer(s) cannot guarantee that any specific photo will be taken. The Photographer(s) will make every effort to accommodate Clientʼs wishes and acknowledges that there is a reasonable expectation of professional quality consistent with the photographers work. The client understands that the work on display through websites, prints, etc. has been retouched and the client will only receive retouched proofs, additionally retouching outside what is included in the package is an extra charge.

•SOUTHERN BELLES BOUDOIR cannot be held liable for factors over which they have no control, which may affect the quality of the photographs, such as Client lateness and photogenicity. Additionally, The Photographer(s) cannot be responsible for the effects of the subjectsʼ physical appearance including body position, facial expressions, blinking or clothing. The Photographer(s) has the right to refuse to produce any image that could violate libel or copyright laws, or in the course of its production could cause or contribute to bodily injury, death, equipment damage or property damage or destruction.

Liability: I am voluntarily participating in physical activity with Southern Belles Boudoir. Having such knowledge, I hereby release Southern Belles Boudoir, their relatives and successors from liability for accidental injury or illness, which I may incur as a result of participating in the said physical activity. I hereby assume all risks connected therewith and consent to participate in said program. Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for themselves and release photographer from any claims against their person or their business.

•PRICING and PRODUCTS. Pricing is defined on The Photographer(s)ʼ standard price list in effect at the date of this contract. All sessions are subject to the 8.375% OK State Tax. Orders placed after the event are billed at the rates in effect on the most recently published price list. All purchases over the amount of included album will be billed to client. Unless otherwise noted, the number of client chosen photographs included in an album is limited based on the size and selection of album chosen (which is specified on our most current price list). Inclusion of additional images will require an upgrade in the number of book pages. Any additional retouching requested by client will be billed at $60 per image. Products are subject to availability from the manufacturer. Shipping and handling charges are not included unless otherwise stated.

•NOTICE OF COPYRIGHT: Southern Belles Boudoir retains all copyrights to all images created during the client’s session. A print release will be included with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, reproduce, scan, download, print, share, alter, or otherwise steal any image created by Southern Belles Boudoir during the client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. ALTERATION OF DIGITAL IMAGES: The alteration of the digital images in this gallery through the use of personal digital image enhancement software, including but not limited to Instagram, Picasa, Lightroom, Photoshop, etc., in any way, is strictly prohibited and is considered a copyright violation under Federal Copyright Law. COMMERCIAL USE/PERSONAL USE FOR MONETARY GAIN: Commercial use, or personal use for monetary gain, on the web or in print is strictly prohibited, unless written permission has been obtained from Southern Belles Boudoir and credit is given to Southern Belles Boudoir. Clients' vendors may email southernbellesok@gmail.com for written permission. OTHER TERMS: Any other utilization or reproduction is specifically prohibited without the express written consent of Southern Belles Boudoir. Nothing contained herein shall be deemed a release of Southern Belles Boudoir copyright on any of the digital images. Client may not resell, re-license, sub-license, or redistribute without express written permission from Southern Belles Boudoir. Use the Media in any way, whatsoever, in which you charge money, collect fees, or receive any form of remuneration, without express written permission from Southern Belles Boudoir. Use the Media in any advertising without express written permission from Southern Belles Boudoir. Use the media in a pornographic, obscene, illegal, immoral, libelous, or defamatory manner. Incorporate the Media into trademarks, logos, or service marks without express written permission from Southern Belles Boudoir.

We never sell images to third parties. Because of this please initial the appropriate options regarding privacy & usage by our studio.

•Southern Belles Boudoir is committed to respecting the privacy of her clients. No images will be shown without the written permission from CLIENT as selected in this clause. Normally, Southern Belles Boudoir will post behind the scenes to their Facebook & other social media pages shortly after the session; will blog the session as images are uploading to the final gallery; will share images on all forms of social media; will update the website galleries to include session images; and will use for promotional uses online and in print. Each client will complete our Image Release Contract once they arrive of their session date.
